1. Agreement Overview
These Terms of Service (“Terms”) constitute a legal agreement between you (“User”) and Kitestring Studio Inc., DBA Kitestring Hosting (“we”, “us”, “our”), a company registered in Seattle, WA. By subscribing to and using our managed WordPress hosting services (“Service”), you agree to comply fully with these Terms.
2. Service Description
Our Service provides managed WordPress hosting specifically optimized for predominantly static content websites. We explicitly do not support complex web applications, including but not limited to Learning Management Systems (LMS), membership sites, or other similar resource-intensive applications.
We reserve the right to block, restrict, or disable plugins or custom code that we deem incompatible or inconsistent with our hosting environment or business objectives. We provide no guarantee regarding the compatibility or performance of any specific WordPress plugins.
3. Acceptable Use Policy
You agree not to host content that may jeopardize the security, stability, or reputation of our platform. Prohibited content includes but is not limited to:
- Adult content, pornography (excluding artistic nudity, subject to our discretion), gambling, or controversial political content.
- Content that advocates harm or violence against individuals or groups.
We reserve sole discretion in determining the acceptability of content. Accounts using excessive server resources may be asked to reduce usage or upgrade their hosting plan.
4. Billing & Payment
Billing is offered monthly or annually, payable in advance. We allow a 30-day money-back guarantee on the first site. If we elect to remove a User from our Service, we may provide a prorated refund for any unused portion of an annual plan.
Accounts overdue by 14 days will be suspended. Accounts overdue by 45 days will be terminated permanently.
5. User Responsibilities
Users maintain full administrative access to their WordPress sites and assume sole responsibility for all content, compliance, legality, and security related to their website.
We reserve the right to mandate the installation or operation of specific plugins or code required for security, performance, or platform stability. We will apply WordPress security updates at our discretion.
6. Backups
Daily backups are provided. Backup retention periods vary based on your service plan. Users may request backup restorations as needed, subject to plan limits.
7. Security
We offer basic security measures, including SSL certificates, malware scanning, and a Web Application Firewall (WAF) via Cloudflare. However, we provide no guarantees regarding the absolute security of User data. We recommend Users only publish content intended for public consumption and explicitly do not support or endorse content gating.
8. Termination
We reserve the right to terminate service without prior notice in cases of non-payment, violation of these Terms, or abusive behaviors toward our staff or resources. Upon termination, all user data will be removed from our systems.
9. Liability & Indemnification
We disclaim all liability for any type of loss or damage resulting from the use of our Services. Users agree to indemnify, defend, and hold harmless Kitestring Hosting from all claims or liabilities arising from their use of our Service.
10. Dispute Resolution
Users agree not to litigate against us. In the event of any dispute, both parties agree to mediation within our home jurisdiction (Seattle, WA).
11. Intellectual Property
Users retain full ownership rights to all content and data hosted on our platform. We reserve the right to showcase or promote User websites for marketing or promotional purposes. Users may opt-out by disabling search engine visibility within their WordPress installation.
12. Third-Party Services
Certain aspects of our Service rely on third-party providers, such as domain registrars, Content Delivery Networks (CDN), and cloud storage. We explicitly disclaim responsibility for downtime, outages, data loss, or other failures arising from third-party providers.
Our email service is basic and does not compete with enterprise solutions such as Gmail or Microsoft 365. No guarantees are provided regarding email service reliability.
13. Changes to Terms
We reserve the right to update or modify these Terms at our discretion. Any changes will be posted within your membership portal. Continued use of our Service constitutes acceptance of updated Terms.
